Tweeps.net Terms of Service
1. General
- These Terms of Service constitute an agreement between the customer ("User") and Tweeps Oy ("Tweeps"). The subject of the agreement is the terms and conditions related to the use of the Tweeps.net service.
- If the user does not agree to these Terms of Service, the use of the service will not be permitted.
- Acceptance of the Terms of Service requires that the user be either an adult, a minor with the consent of their guardian, or another legal entity such as a company. If you use the Service on behalf of a company or other organization, you must have the authorization to accept these terms on its behalf.
- Through the Service, it may be possible to access third party services, products and materials. Tweeps is not responsible for the services, products and materials provided by third parties, even if used through the Tweeps.net service. These Terms of Service cover the use of any third party services, products and materials only in the Tweeps.net service, and the customer may not use them for any other purposes on the basis of this Agreement.
- Tweeps reserves the right to change these Terms of Service and the prices of paid services. The user undertakes to review changes in the terms and conditions from time to time and to comply with the changes immediately.
- The user’s personal data will be processed in the Tweeps.net service in accordance with the Privacy Policy on the basis of this agreement. In addition, by accepting these Terms of Use, you expressly consent to the transfer of any personal data that may be associated with your X account outside of the EU, such as the United States and other countries in which X operates.
- This agreement may be amended or supplemented by a written service agreement between the parties, for example in connection with ordering paid services. In this case, the service agreement between the parties takes precedence over these terms of service.
2. Definitions
- "Tweeps.net Service" or "Service" means the online service at tweeps.net, including all of its functions.
- "X Content" means any data or other content in any form created or posted on X and displayed or otherwise made available in the Tweeps.net service. This refers to, for example, X users’ IDs, profile pictures, number of followers, following relationships, posts ("tweets"), photos, and videos.
- "X User Data" refers to information that discloses the name, user ID, associated key figures of one or more X users, and / or following relationships between X users.
- "Downloaded Material" refers to any data or content downloaded or otherwise stored in the Tweeps.net service that contains X Content or which has been compiled using X Content in part.
- "Registration or Login" means the functions of the Tweeps.net service in which a user either creates a login username or logs in to the service using a X account.
- "Paid Services and Content" means features of the service and materials displayed or downloaded that require a prior subscription or payment
3. Logging in and X account
- Some features of the Tweeps.net service are available without registering or logging in. These Terms of service apply to the use of the service in all cases.
- If you register or log in to the Tweeps.net service, you are responsible for protecting your ID and password from unauthorized access. You may make them available only to a person or entity who agrees to abide by these Terms of Service.
- To log into the service, you may only use a X account that you control or have permission to use.
- If you log in to the Tweeps.net service with your X account, you give consent to Tweeps to do the following:
- pass on your information to X (such as your ID and searches),
- store information related to your X login (we will not store your password and it will not be known to us),
- use your X account in the X software interface to search for X content,
- keep the X content that is retrieved in this manner available to other users of the Tweeps.net service, subject to the publicity and possible restrictions of the X content.
- The features of the Tweeps.net service and the X content you see on the service may depend on the settings and restrictions associated with your X account. For example, you won’t be able to see all the information in the Tweeps.net service about users who have blocked you on X.
- You may use the service with more than one X account, but you may not thereby circumvent the restrictions of the service or the X interface.
- We will not share non-public information of your X account with other users or entities. We may publish your public profile information (such as your name, ID, profile picture, and description text).
- If the X account you use has been deleted or suspended, you will no longer be able to sign in to the Tweeps.net service with it.
4. Right to Access the Service
- Tweeps grants users a limited and revocable non-exclusive license to use the Tweeps.net service.
- The functionality, content, and publicity of the content are subject to change. Tweeps is not responsible for the content of the service and is not obligated to make previous content of the service available again.
- The user is responsible for ensuring that the devices, software and network connections he or she uses are compatible for using the Tweeps.net service and will not cause any unusual load or other damage to the service.
- Tweeps may suspend or block the user from accessing the service if the user violates the terms of the agreement between the parties or for any other reason.
- By using the service, you agree that we may disclose information arising from your use of the service, including statistics, summaries and other derivative works compiled from it.
- You may not make the paid services and content you subscribe to or purchase available to others.
5. Permitted use
- The Tweeps.net service is designed to analyse X users, compile statistics on X users, and to track them.
- X content available through the Service may only be used in accordance with X’s Terms of Service and Developer Terms.
- The statistics and graphs compiled by the service may be downloaded and published, indicating the source and time.
- If downloaded material contains X user data (which may contain personal data), you may use it only for personal or household purposes, or you must have a legal basis for storing and using it in accordance with general EU data protection regulation, and you are responsible for this as a controller.
6. Prohibited use
- The service may not be used to harass, bully or otherwise violate the legal rights of any individual or group of people.
- X content obtained through the service may not be used in a manner that can reasonably be expected to violate the privacy of X users.
- The service may not be used for any analysis or research that is discriminatory or otherwise illegal against individuals or groups of people.
- In addition, the service may not be used for the following purposes:
- surveillance or intelligence,
- monitoring sensitive events such as demonstrations or community gatherings,
- targeting, segmentation or profiling based on health (including pregnancy), financial status, political orientation, religious or philosophical beliefs, racial or ethnic origin, sexual or sexual orientation, trade union membership, alleged or actual criminal offense, or other sensitive personal data whose processing is restricted by law.
- The service may not be used for the control of citizens by the government, and material downloaded from the service may not be disclosed to persons whose primary task is to exercise control or gather intelligence.
- Circumvention of the restrictions on the use of the service and manipulation of the functions by programming (including screen scraping) are prohibited.
- You may not attempt to copy, modify, create derivative works from, frame, mirror, republish, or download the Tweeps.net service, in whole or in part, in any form or by any means that is not an express use of the Service.
